1. Acceptance of Terms

By accessing or using CardNews AI (the “Service”) operated by ILanding (“we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

2. Description of Service

CardNews AI is a web-based SaaS platform that enables users to generate AI-powered card news content. The Service includes:

• AI-generated text content via large language models
• AI-generated images via image generation models
• Stock photo search integration
• Card design templates and a canvas-based editor
• Export of finished cards as PNG images
• Storage of your card news projects

3. Account Registration

To use the Service, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party
• Be at least 13 years of age to use the Service

4. Credits and Billing

4.1 Credit System

The Service operates on a credit-based system. Credits are consumed as follows:

• New accounts receive 20 free credits upon registration
• AI text generation: 1 credit per generation
• AI image generation: 1 credit per image
• Stock photo search: free (no credits deducted)

4.2 Paid Plans

Additional credits can be purchased through paid subscription plans processed via Polar. All payments are subject to Polar’s terms and conditions. Subscription fees are billed in advance on a monthly basis.

4.3 Refunds

We do not offer refunds for consumed credits or partial billing periods. If you believe you were charged in error, contact us within 14 days of the charge.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Create content that infringes on intellectual property rights of third parties
• Produce spam, disinformation, or misleading content
• Attempt to reverse engineer, hack, or disrupt the Service
• Scrape, crawl, or systematically extract data from the Service
• Resell or sublicense access to the Service without authorization
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

6. Intellectual Property

6.1 Your Content

You retain ownership of the content you create using the Service. By using the Service, you grant ILanding a limited, non-exclusive license to store, process, and display your content solely to provide the Service.

6.2 AI-Generated Content

Content generated by AI models is provided for your use subject to applicable laws. You are responsible for ensuring that your use of AI-generated content complies with all applicable laws and third-party rights. We make no warranties regarding the originality or copyright status of AI-generated content.

6.3 Service IP

The Service, including its design, code, templates, and branding, is owned by ILanding and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or suitable for any purpose
• Results obtained from using the Service will meet your expectations

We are not responsible for the accuracy of AI-generated text or images. Always review content before publishing or distributing it.

8. Limitation of Liability

To the fullest extent permitted by law, ILanding shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration or in competent courts, as required by applicable law.
